These terms cover your use of this website and the work we do for clients. DBF Digital (ABN 57 466 711 378) is an Australian digital marketing business based in Victoria. In these terms, we and us means DBF Digital, and you means the person or business using this site or engaging us.
Using this website
The information on this site is general in nature. We keep it as accurate and current as we reasonably can, but we do not warrant that it is complete or free of errors. Nothing here is advice tailored to your situation. If you want that, get in touch and we will talk about your business properly.
You are welcome to read, print and share pages from this site for your own use. Please do not reuse our content, designs or case studies commercially without asking us first.
Quotes and proposals
Any quote or proposal sets out the work, the price and the timeframe for that specific job, and is valid for 30 days unless we say otherwise. Work starts once you accept the proposal in writing, which can simply be an email, and once we receive any deposit that applies.
If what you need changes partway through, we will talk it through and confirm any change to price or timing in writing before carrying on.
What we need from you
To do good work, we rely on you to:
- give us the content, images, branding and information we ask for
- provide access to the accounts, platforms and systems we need
- give feedback and approvals within a reasonable time
- make sure what you supply is accurate and that you have the right to use it
If we are held up waiting on something from you, timeframes move accordingly. We will tell you when that happens rather than letting a deadline quietly slip.
Fees, invoices and GST
All prices are in Australian dollars. Where GST applies, it is shown on your invoice.
Unless your proposal says otherwise, invoices are payable within 14 days, and ongoing retainers are invoiced monthly in advance. If an invoice falls well overdue we may pause work until it is settled, and we will let you know before we do.
Advertising spend
Advertising budgets for platforms such as Google and Meta are separate from our fees. Depending on what we agree, you will either pay the platform directly or reimburse us. That spend goes to the platform rather than to us, and we cannot refund it.
Results
We bring real experience and effort to every engagement, and we will be straight with you about what we expect to achieve. What we cannot do is guarantee specific outcomes such as search rankings, lead volumes, conversion rates or revenue. Search engines and advertising platforms change their systems regularly, and your market, competitors and pricing all play a part.
What we do commit to is doing the work properly, reporting honestly on what is happening, and telling you promptly when something is not working.
Who owns what
Once you have paid in full for a piece of work, you own the final deliverables we created for you, including your website design, copy, graphics and campaign assets.
We keep ownership of the underlying tools, templates, frameworks and know-how we use across clients, along with anything licensed from a third party such as stock images, fonts, plugins and themes, which stays subject to its own licence.
We like to show finished work in our portfolio and case studies. If you would rather we did not, just say so and we will leave it out.
Third-party platforms
Our work often involves platforms we do not control, including hosting, WordPress, plugins, Google and Meta. Those services set their own terms and pricing and occasionally go down, and we are not responsible for changes or interruptions on their side. Where we manage an account on your behalf, that account remains yours.
Confidentiality
We treat your business information as confidential and will not share it beyond what is needed to do the work. We ask the same of you for anything commercially sensitive we share with you. How we handle personal information is set out in our Privacy Policy.
Pausing or ending work
For project work, either of us can end the engagement in writing. You pay for the work completed to that point, and we hand over what has been finished.
For ongoing retainers, either of us can finish up with 30 days written notice. We will see out the notice period and give you a proper handover of accounts and assets.
Your rights under Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, you are entitled to services supplied with due care and skill and fit for the purpose we have agreed. Nothing in these terms limits those rights.
If there is a major failure in our services, you are entitled to cancel and receive a refund for the unused portion, or compensation for a reasonably foreseeable drop in value. For problems that are not major, you can ask us to put them right.
Our liability
Subject to those consumer guarantees, and to the extent the law allows, our liability for any claim connected with our services is limited to resupplying the services or paying the cost of having them resupplied. We are not liable for indirect or consequential losses such as lost profits or lost business opportunities.
Changes to these terms
We may update these terms from time to time. The current version will always be on this page with the date it was last updated at the top. Changes do not affect work already underway under an agreed proposal.
Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction.
